This is the privacy policy (“Privacy Policy”) that governs how we, EMPTYSEAT (“CRE8 TECHNOLOGIES,” “we,” “our" or “us”), use Personal Information (as defined below) that we collect, receive and store about individuals and/or companies in connection with the use of: (i) the EMPTYSEAT event management service (“ EMPTYSEAT Service”), (ii) the website https://www.emptyseat.app , and any other website that we operate (each, together with its sub-domains, content and services, a “Site”); and (iii) the EMPTYSEAT web and mobile service application ("App"); and any other services we provide (each individually, and collectively, the “Service”) - all, as we will provide, develop and enhance from time to time. The EMPTYSEAT Service, Sites, App and any additional Services are individually and collectively referred to herein as the “Services.”

The use of your personal information under this policy is an integral part of the Services. You are not required by law to provide us with your personal information, and therefore providing your information is entirely up to you. However, if you do not provide us with the necessary information, we will not be able to provide you with our services. Therefore, if you do not agree to this Privacy Policy, please do not access or otherwise use the Services.

We may change this Privacy Policy from time to time, to adapt it to changes in our Services, to the way EMPTYSEAT operates, and to regulatory and technological requirements. We will provide notice about the updated policy within a reasonable time in advance to allow you to review the changes and decide whether you wish to continue using the Service. Our notices will be posted, as applicable, on the Site, and we will also send it to you with an email message.

1. Introduction.

We have implemented this Privacy Policy because your privacy, and the privacy of other users, is important to us. This Privacy Policy explains our online information practices and the choices you can make about the way we collect and use your Personal Information in connection with the Services. “Personal Information” means any information that will be used, either alone or in combination with other information, to personally identify an individual, including, but not limited to, a first and last name, a personal profile, an email address, a home or other physical address, or other contact information.

2. Terms of Use.

This Privacy Policy forms part of our EMPTYSEAT End User Terms of Service and Organizer Terms which can be viewed on the Site and which you accepted prior to using the Service for the first time (collectively, “Terms”). Any capitalized but undefined term in this Privacy Policy will have the meaning given to it in the Terms.

3. What Personal Information We Collect and How We Collect It.

We do not currently require you to provide Personal Information in order to have access to general information available on the Services. But, we do receive and/or collect Personal Information from you in the following ways:

  To use certain Services, you will be required to create an account (“Account”). We offer different options to create an Account, including

  If you send us a “Contact Us” request, whether by submitting an online form that we make available or by sending an email to an email address that we display, you will be required to provide us with certain information, such as your name and email address in order to send the message to us. • 3.3 Share with Friends Service.
  Services enable you to invite your friends to use our Services by sending them an invitation email message or a text message. You may do so by: (i) using the Services to send or post an invitation message via your Third Party Account; and/or (ii) using the Services to send an invitation email to your friend’s external email address. If you send or post an invitation message, we will store Personal Information about the recipient such as their email address or their third party website account user name and ID.

• 3.4 Location Data.
  We provide certain location-based services (“Location Services”) in connection with the Services that are dependent on data related to the geographic location of your mobile device used for the Service (“Location Data”). If you choose to participate in these Location Services, you agree that we will collect or obtain your Location Data. You may use the settings on your mobile device to turn off location-sharing features.

• 3.5 Profile.
  Some parts of the Services enable you to build a public profile in connection with your Account (“Public Profile”). Your Public Profile will include your name and other information that you choose to include in your Public Profile, such as your gender and a profile picture, and you can control which such information will appear on your Public Profile. In some cases, even if you do not create a Public Profile, the applicable Event Organizer may create a public profile for you, based on the information you provided while registering for the Services or event,

    ANY TICKET PURCHASED THROUGH THE EMPTYSEAT PLATFORM IS MEANT SOLELY AND EXCLUSIVELY FOR PERSONAL USE BY THE PERSON IN WHOSE NAME THE TICKET HAS BEEN ISSUED. TICKETS ARE NOT A TRANSFERABLE PROPERTY AND CANNOT BE RESOLD, TRANSFERRED OR CONVEYED TO ANY PERSON UNLESS PRIOR WRITTEN AND EXPRESS PERMISSION HAS BEEN PROVIDED BY THE EVENT ORGANIZER. ANY PERSON FOUND ABUSING TICKETS FOR PERSONAL GAIN OR FOR COMMERCIAL USE SHALL BE LIABLE TO SUITABLE LEGAL PROCEEDINGS INCLUDING THOSE RELATED TO BLACK MARKETING AND FINANCIAL & CRIMINAL FRAUD.
    
    If emptyseat or the Event Organizer finds that You are transferring or selling, or You had in the past transferred or sold, Your tickets, including m-ticket or band, through any mode, including social media platforms, other ticketing platforms, by hand, thereby allowing any other person to access the Event without purchasing the ticket from EMPTYSEAT Platform, then EMPTYSAET or the Event Organizer may initiate suitable legal proceedings.
    
    Tickets once sold cannot be exchanged, cancelled, modified, transferred, or refunded, and You shall not make any request for modifications in the ticket, including change in date, time, location, or category unless the Event Organizer has specified so in the Event’s terms and conditions. Please make sure You check the date, time, and location before You book Your tickets. But we’d still advise You to read the terms and conditions for each Event regarding exchange, cancellation, modification, transfer, and refund. If You wish to change or modify your ticket details, the same shall be entirely at the discretion of the Event Organizer.
    
    If an Event is cancelled or postponed and the Event Organisers of such Event agree on issuing a refund for the tickets, it shall be the Event Organiser's sole responsibility to contact You and process the refund and EMPTYSEAT and/or CRE8 TECHNOLOGIES shall have no liability in this regard. However, the booking fee charged by EMPTYSEAT is non-refundable. If the Event Organizer informs EMPTYSEAT to process the refunds on their behalf, Your refunds may reflect in Your account within seven (07) to ten (10) working days from the date of receiving the refund request.
